3. Submitted Information

You commit to not posting content on the Site that breaches any laws, privacy, or intellectual property rights, includes explicit material, promotes illegal activities, carries harmful software, is irrelevant, or involves unsanctioned ads or solicitations. You’ll shield EVOLV from any legal or financial repercussions of your site usage. In submitting content, you give EVOLV and other users permission to freely utilize, modify, and share that content, adhering to site guidelines. EVOLV can monitor and control site content but is not obligated to do so.

 

4. Third Party Information

The EVOLV logo is owned by Zero Impact Solutions, a subsidiary of Zero Impact Energy, and cannot be used without explicit authorization. Trademarks for other mentioned products or names belong to their respective owners.

 

6. Miscellaneous

This Agreement is the sole contract between you and EVOLV, covering the subject matter. Without EVOLV’s written approval, no part of this Agreement can be transferred. California law governs this Agreement, excluding choice of law rules. EVOLV reserves the right to terminate or limit your site access if you breach this Agreement, with or without notice.

Both parties can end this Agreement anytime without a specific reason. However, your responsibilities under this Agreement persist after termination, except for using the Site. You agree that any legal matters related to this Agreement or the Site will be handled in Orange County, California courts. EVOLV may respond to law enforcement inquiries or subpoenas related to your site usage.

EVOLV may update this Agreement at any time by posting new terms on the Site, effective immediately. Failure to enforce any part of this Agreement doesn’t waive the right to enforce it later. If any clause is voided, the rest remain valid, with voided clauses replaced to reflect the original intention. Affiliates of EVOLV gain from this Agreement’s provisions. Rights not explicitly granted here are reserved.

 

 

 

 

7. Commercial Computer Software

All software and data on the Site are a “commercial item,” as that term is defined at 48 C.F.R. 2.101 (Oct. 1995) consisting of “commercial computer software” and “commercial computer documentation,” as such terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Governmental users acquire the information with only those license rights set forth herein.
